What is Commercial Litigation?

Commercial litigation is similar to civil litigation and in some ways the distinction is artificial. Commercial litigation really means a dispute between businesses or between a business and an individual, as opposed to two or more individuals.

We are used to dealing with commercial litigation arising from all kinds of situations, some examples are listed below:-

• Breaches of contracts or agreements
• Negligence
• Intellectual property disputes
• Disputes with HMRC, ARA and other government agencies.

Although each set of facts is unique, whatever problems you have, we will have dealt with cases like it before.

HMRC Disputes

A particularly prevalent problem at the moment is disputes with HMRC in the computer component, CPU, software and mobile phone trade.  In an attempt to stop VAT fraud in this area, HMRC have deployed tactics, which are inhibiting traders in their trading.  These include delays in reimbursing reclaimed VAT, cancelling VAT numbers, refusing to complete verification of returns and spot checks to inspect due diligence and other records.
